Terms of Service
By using BidVault you agree to the following terms. These are not intended to be a substitute for legal advice; if you are operating a commercial account on the platform, please have a solicitor review these terms before you rely on them.
1. Accounts
You must be at least 18 years old to register. You agree to provide accurate information when registering and to keep that information up to date. You are responsible for all activity that occurs under your account. If you suspect your account has been compromised, please contact us immediately.
2. Bidding and winning
A bid is a binding offer to purchase the item at the bid amount, subject to the auction's reserve price. Once you are the winning bidder at the close of an auction, you are obliged to pay the seller the full amount due (hammer price plus buyer's premium and VAT) by the payment deadline shown on your dashboard.
3. Selling
As a seller, you confirm that you have the right to sell the items you list, that the items are described accurately and that they are not prohibited by UK law. Listing fees are non-refundable. The platform takes its fee from successful sales as described in the Pricing & Fees page.
4. Late payment and non-payment
If you do not pay by the deadline, a late payment penalty as described on the Pricing page may be applied to the amount owed. Persistent non-payment may result in your account being suspended and any listings cancelled.
5. Collection
Unless otherwise agreed between buyer and seller, the buyer is responsible for collecting the item from the collection address by the collection deadline. The collection address is revealed to the buyer once payment has cleared.
6. Platform changes
Fees set on your auctions at the time of publishing do not change retroactively if the platform's fee schedule is updated. Other terms may be updated with reasonable notice.
7. Limitation of liability
BidVault facilitates transactions between buyers and sellers but is not itself a party to those transactions. We accept no liability for items sold on the platform, including their authenticity, quality or legality. Disputes between buyer and seller should be resolved directly in the first instance; where escalation is required, please use the Contact page.
8. Governing law
These terms are governed by the laws of England and Wales. Any dispute arising from them is subject to the exclusive jurisdiction of the courts of England and Wales.
